TERMS AND CONDITIONS OF SALE
1. Purpose and Scope
These General Terms and Conditions of Sale (GTC) govern the sales of products made on the Ultraoutil website between:

hereinafter referred to as “Ultraoutil” or “the Seller”,
and any person making a purchase on the site, hereinafter referred to as “the Customer”.
The Customer acknowledges having read these GTC before placing an order. Validation of the order implies acceptance of these GTC.
2. Products
The products offered for sale are those presented on the Ultraoutil website, subject to availability.
Ultraoutil takes the utmost care in the presentation and description of products. Photographs, illustrations and representations are, however, presented for illustrative purposes and may show slight differences from the delivered product, particularly in terms of color or presentation, without affecting its essential characteristics.
The essential characteristics of each product are indicated on its product sheet.
3. Prices
Prices are indicated in euros, all taxes included (TTC), unless otherwise specified.
Any delivery charges are indicated to the Customer before final validation of their order.
Ultraoutil reserves the right to modify its prices at any time. The applicable price is the one displayed at the time of order validation.
4. Order
The Customer selects the products they wish to purchase and adds them to their cart.
Before final validation, the Customer can check the details of their order, its total price and correct any errors.
The order becomes final after payment validation, subject to its acceptance by Ultraoutil.
An order confirmation is sent to the Customer electronically.
Ultraoutil reserves the right to refuse or cancel an order, particularly in cases of suspected fraud, payment incidents, clearly erroneous information or product unavailability.
5. Payment
Payment is made using the payment methods offered on the site when ordering.
The Customer guarantees that they have the necessary authorizations to use the chosen payment method.
Transactions may be processed by secure payment providers offered by Shopify, among others.
The order may be suspended or canceled if payment is refused by the bank or payment provider.
6. Delivery
Products are delivered to the address indicated by the Customer when placing their order.
Available delivery zones, methods, prices and times are indicated during the ordering process.
Ultraoutil undertakes to deliver products within the time indicated to the Customer or, where no specific time has been agreed, at the latest within the applicable legal period.
In the event of delivery delay, the Customer benefits from the rights provided for by applicable French legislation.
The Customer must provide a complete and accurate delivery address. Ultraoutil cannot be held responsible for any delay or impossibility of delivery resulting from erroneous or incomplete information communicated by the Customer.
7. Receipt of Order
Upon receipt, it is recommended that the Customer check the condition of the package and products.
In the event of a visibly damaged package or a deteriorated product, the Customer is invited to inform Ultraoutil as soon as possible at ultraoutil@gmail.com, providing photographs if possible to show the problem.
This step does not deprive the consumer of the guarantees and rights they legally benefit from.
8. Right of Withdrawal
In accordance with the provisions of the Consumer Code, the consumer generally has a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to justify their decision.
To exercise this right, the Customer must clearly notify Ultraoutil of their decision to withdraw, particularly by email to:

The Customer can also use the standard withdrawal form at the end of these GTC.
9. Return after Withdrawal
After notifying their withdrawal, the Customer has the applicable legal period to return the product.
Unless otherwise indicated or expressly announced by Ultraoutil, direct return costs are borne by the Customer.
The Customer is responsible for any depreciation of the product resulting from handling other than that necessary to establish its nature, characteristics and proper functioning.
The product must be returned with its accessories and, as far as possible, in a condition allowing it to be resold.
10. Refund
In the event of a valid withdrawal, Ultraoutil will refund the amounts due in accordance with the provisions of the Consumer Code.
The refund will be made using the same payment method as that used during the order, unless the Customer expressly agrees to another method that incurs no cost to them.
Ultraoutil may defer the refund until the product has been recovered or until the Customer provides proof of its shipment, in accordance with applicable legal provisions.
11. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in cases provided for by law, particularly to certain products made to consumer specifications or clearly personalized, to goods liable to deteriorate rapidly, and to certain unsealed products that cannot be returned for reasons of hygiene or health protection.
When an exception concerns a product sold by Ultraoutil, this information is specified to the Customer before the order.
12. Legal Guarantees
Consumers benefit from applicable legal guarantees, particularly the legal guarantee of conformity provided by the Consumer Code and the guarantee against hidden defects provided by the Civil Code.
These guarantees apply regardless of any commercial guarantee offered by the manufacturer or Ultraoutil.

13. Manufacturer's Commercial Warranty
Some products may benefit from a commercial warranty offered by their manufacturer.
The duration and conditions of this warranty are those specified by the manufacturer for the product concerned.
This possible commercial warranty does not replace or limit the legal guarantees enjoyed by the consumer.
14. Liability
Ultraoutil cannot be held responsible for improper use of the product, use contrary to its intended purpose or manufacturer's instructions, or deterioration resulting from a fault of the Customer.
No provision of these GTC may have the effect of excluding or limiting a right or guarantee that the consumer mandatorily benefits from by law.
15. Personal Data
Personal data collected during the order is processed in accordance with applicable regulations.
Detailed information concerning data processing and user rights is provided in the Privacy Policy of the Ultraoutil website.
16. Consumer Mediation
In accordance with the applicable provisions of the Consumer Code, the consumer may, free of charge, have recourse to a consumer mediator for the amicable resolution of a dispute with Ultraoutil, after having first sent a written complaint to the Seller.

18. Applicable Law and Disputes
These GTC are subject to French law.
In case of dispute, the Customer is invited to contact Ultraoutil to first seek an amicable solution.
When the Customer is a consumer, they retain the benefit of the mandatory rules of jurisdictional competence applicable to them.
19. Modification of GTC
Ultraoutil may modify these General Terms and Conditions of Sale, particularly to take into account legislative, regulatory or commercial developments.
The GTC applicable to an order are those accepted by the Customer at the time of that order.
